Agreement to Terms.
By accessing or using any of Nexmira's services, you acknowledge that you have read, understood, and accepted these Terms. If you are acting on behalf of a business or organisation, you confirm that you are authorised to enter into this agreement on its behalf.
Description of Services
Nexmira offers practical, AI-powered tools designed to help individuals and small-to-medium businesses simplify communication, automation, and workflow tasks. Our current services include:
- NexAgentix – an intelligent AI agent that combines live chat automation and voice reception to assist with customer interactions.
- NexAssist – a private AI assistant built to help users draft, organise, and automate tasks securely.
- NexProb – a smart AI engine that supports practical problem-solving and automation of repeatable workflows.
These services are built with personalisation and usability in mind—no complex infrastructure required.
User Responsibilities.
When using Nexmira's services, you agree to:
- Provide accurate and up-to-date information
- Maintain the confidentiality and security of your login credentials
- Third-party integrations (e.g., Facebook SDK, Google Analytics)
- Use the services in accordance with applicable laws, including privacy, copyright, and consumer protection
- Not misuse the services, attempt to gain unauthorised access, or disrupt service functionality
- Not use the services to create or share unlawful, offensive, misleading, or abusive content
Acceptable Use Policy.
Our services must be used responsibly and ethically. You must not:
- Use Nexmira tools to generate or disseminate false, harmful, or discriminatory content
- Engage in phishing, impersonation, or spam using AI-generated content
- RMine or harvest personal data without appropriate consent
- Circumvent access controls or reverse engineer our platforms
Breaches may result in suspension or termination of access without notice.
Intellectual Property.
All content, software, and underlying technology made available through Nexmira is the property of Nexmira or its licensors. This includes:
- Source code, models, and algorithms
- Interface designs and visual elements
- Trademarks, brand names, and product identities
You are granted a limited, non-exclusive licence to use our services for your internal purposes. You may not copy, modify, distribute, or republish any part of the services without our prior written consent.
Payment and Subscriptions.
For services requiring payment:
- TAll prices are quoted in Australian Dollars (AUD) unless otherwise specified
- Subscription plans are billed in advance on a monthly or annual basis
- Subscriptions renew automatically unless cancelled before the next billing cycle
- We use secure third-party payment processors
- Refunds are issued in accordance with your rights under the Australian Consumer Law
Failure to pay may result in suspension of your access until resolved.
Privacy and Data Protection.
Your use of our services and products is subject to our Privacy Policy, which outlines how we collect, handle, and protect your data in line with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).
Service Availability and Changes.
We aim to maintain high service reliability but do not guarantee uninterrupted access. We may:

- Introduce, modify, or remove features to improve performance or ensure legal compliance
- Change pricing or subscription structures with prior notice
We are not liable for delays or interruptions beyond our reasonable control.
Limitation of Liability.
To the extent permitted by law:
- Services are provided "as is" without warranties of any kind
- Nexmira shall not be liable for indirect, incidental, or consequential losses, including lost data or revenue
- Our total liability is limited to the amount paid by you for the services over the past 12 months
These Terms do not exclude or restrict your rights under the Australian Consumer Law.
Suspension and Termination.
We reserve the right to suspend or terminate your access if:
- You breach these Terms or applicable laws
- We detect misuse, abuse, or unauthorised access
- Continued access poses a risk to our systems or other users
In non-urgent cases, we will provide reasonable notice before taking such action.
Dispute Resolution and Jurisdiction.
We encourage you to contact us directly to resolve any concerns. If a dispute cannot be resolved informally:
- Both parties agree to attempt mediation before legal proceedings
- These Terms are governed by the laws of the State of Victoria, Australia
- Any legal claims will be subject to the exclusive jurisdiction of the courts of Victoria
Changes to These Terms.
We may update these Terms from time to time to reflect changes in our services or applicable regulations. When we do:
- The revised Terms will be published on our website
- We will provide notice to existing users where material changes are made
Continued use of our services after changes are made constitutes acceptance of the updated Terms.
